    Read the following terms and conditions carefully before sharing your video with Michigan State University (“MSU”). Your submission allows MSU to use it pursuant to the terms and conditions provided below. By uploading video content or providing MSU with a link to your content available through another platform (collectively, “Content”) or by filling in the space next to “I’ve read and agree to the terms and conditions” indicates your acceptance of these terms and conditions. If you do not agree with such terms and conditions, do not share your Content with MSU.

    1. MSU Permissions and Restrictions. For purposes of creating Content for submission to MSU, MSU grants you permission to perform and record the MSU fight song (the “Fight Song”). You agree that (a) MSU retains any and all rights related to the Fight Song and (b) you will not use the Fight Song or any Content for commercial purposes.
    2. Your Content. You acknowledge and agree that your Content shared with MSU may be used, reproduced, displayed, modified, deleted, added too, adapted, and published by MSU in any media formats and any media channels (for example, on its websites or newsletters or in advertising campaigns). You grant MSU a worldwide, irrevocable, transferrable, sub licensable, fully-paid and royalty-free, and non-exclusive license to use, reproduce, display, modify, delete from, add to, adapt, publish, and prepare derivative works from your Content. You further acknowledge and agree that you are responsible for the development of your Content.
    3. Names and Likeness. You hereby grant to MSU a worldwide, irrevocable, transferrable, sub licensable, fully-paid and royalty-free, and non-exclusive license to use any other individual's likeness and, where such other individuals appear in the your Content, in connection with MSU’s use of the your Content. You also agree not to assert any privacy, publicity, moral, or similar rights you may hold (and to the extent any other person(s) whose name(s), videos and/or likeness(es) and/or performances are embodied in the your Content, you represent and warrant that you have obtained all necessary consents from such third parties consistent with the full scope of rights granted to MSU pursuant to this Agreement, and you agree that such persons shall not assert any intellectual property, privacy, publicity, contractual, moral or similar rights, or make any claims that any your Content is objectionable or otherwise defamatory) under the laws of the United States and any other country in connection with the exploitation of such materials as described hereunder.
    4. Privacy. Michigan State University may request or collect certain limited information about you when you submit your video. Such information might consist of your name, if you provide it, your email address, and device identification as well as technical data and related information, including but not limited to technical information about your device, system, and application software. Your submission may also use cookies or other passive tracking mechanisms and tools to collect information in order to facilitate your use of video submissions.
    5. Your Representations and Warranties. You represent and warrant that you possess the legal right and ability to agree to this Agreement, and that all information or material that you transmit through your video is true, accurate, and current. You agree that you will not: (i) transmit any material that is copyrighted, protected by trade secret, or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have written permission from their rightful owner to post the material and to grant the right to use such materials as provided in this Agreement; (ii) submit any false information or misrepresentation that could result in liability or damage to MSU or any third party; (iii) submit any material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, graphic or gratuitously violent, harassing, hateful, racially or ethnically offensive, encourages conduct that would give rise to criminal or civil liability, violate any law, or is otherwise inappropriate; (iv) impersonate another person; (v) or transmit worms, viruses, or other malicious codes. You agree that you will defend, indemnify, and hold MSU harmless against any claim arising out of or related to your failure to comply with the terms of this Section 5.
    6. LIMITATION OF LIABILITY. Your submission of Content is entirely at your own risk. To the extent permitted by law, in no event will MSU, its licensors, suppliers, or dealers be liable to you for any actual, direct, indirect, incidental, special, consequential, or punitive damages, including any lost profits, lost savings, costs of procurement of substitute products or services, or other damages arising out of the use or inability to submit your video even if advised of the possibility of such damages. Some states and countries do not allow the limitation or exclusion of liability for incidental or consequential damages, or have legislation that restricts the limitation or exclusion of liability, so the above limitation may not apply to you.
    7. Governing Law. This License is governed by the laws of the State of Michigan, without regard to Michigan’s conflict of law rules. You irrevocably consent to the exclusive jurisdiction of the Michigan Court of Claims and the federal district court in the Western District of Michigan, United States of America, for the purposes of any legal action arising out of or related to the submission of your video or these terms.

    When is the deadline to submit my video? Submit your video any time before August 26, but the sooner the better.

    How long will it take to upload my video? Upload time depends on your connection speed and the size of your final video file. Larger files will always transfer faster over hard lines than by a wireless connection.

    Will I get an email when my video has successfully uploaded? No, but there will be a confirmation that the upload was successful.

    Can I upload more than one video? Yes, however each video must be uploaded individually. Simply fill out the upload form again and submit a new file.

    How should I shoot my video? Use your smartphone or other video recording device, and place yourself in the center of the screen. Make sure there is enough light so we can see your face and remember to use earphones so all we hear is your voice. Setting your camera to the highest quality is best. If using a smartphone, remember to turn your camera sideways to record in a horizontal orientation.

    Can I email my video? No. Emailing a video will further compress the video and decrease the quality.

    Can I submit a link to my video? Yes. You can provide a link on the upload submission form.
